Terms & Conditions
These are the terms and conditions on which, BG VOLEYBALL ACADEMY LTD (‘We’), supply our children’s weekly volleyball sessions (‘Sessions’).
1. Booking Our Sessions
1.1. Health issues. Please notify us when you request a booking whether any child has any health, allergy or learning difficulties. We do not offer or provide any medical supervision and our Sessions may not be suitable for all children.
1.2. Warranty. By requesting a booking with us, you warrant that you are the parent or guardian of any relevant child and that you have the legal right to make such a booking for Sessions and to comply with these terms.
2. Providing the Sessions
2.1. Term Sessions. If you have booked Term Sessions (being a course of Sessions for an academic term), We shall supply our Sessions to you until the end of the relevant academic term (‘Term’).
2.2. We are not responsible for delays outside our control. If our supply of any Session is prevented because of an event outside our control, then We will contact you as soon as possible to let you know.
2.3. If We cannot provide a Session due to your child’s absence, We will not offer you a refund for the missed Session. Please refer to our Non-Refund Policy for more details (Clause 3).
2.4. If We cannot supply a Session ourselves, then you will be entitled for a refund (on a pro-rata basis), which will be made as soon as possible. Please refer to our Non-Refund Policy for more details (Clause 3).
3. Non-Refund Policy
3.1. All payments made to BG Volleyball Academy — including term Session bookings and camp fees — are non-refundable unless otherwise stated in writing.
3.2. Why We have this policy. We operate based on planned bookings, hall rentals, and staff commitments that are made in advance. Your payment secures your place and covers fixed costs whether you attend or not. Refunds would compromise our ability to deliver consistent programming for all members.
3.3. What This Applies To. Term Session bookings, camp fees, day Sessions and 1-1 coaching.
3.4. Refunds may be issued in the following rare cases:
3.4.1. Session cancellation by BG VOLEYBALL ACADEMY
3.4.2. Medical withdrawal (with evidence and at BG VOLEYBALL ACADEMY’s discretion)
3.5. In all other cases, missed Sessions, illness, travel plans, and scheduling conflicts do not qualify for a refund.
3.6. If you are entitled for a refund, We will make it as soon as possible, using the same method you used for payment.
3.7. Removal from BG VOLEYBALL ACADEMY’s Sessions due to breach of Code of Conduct, disciplinary action, or safeguarding concerns does not qualify for a refund.
4. Your rights to end the contract
4.1. In the unlikely event of BG VOLEYBALL ACADEMY permanently cancelling the Sessions during or before the start of term, you have a legal right to receive a full or partial refund:
4.1.1. Cancellation before the start of the term. We will issue a full refund.
4.1.2. Cancellation during the term. We will issue a partial refund, for any Sessions in the future that you paid for but which your child will not attend.
4.2. Ending the contract where We are not at fault. If We are not at fault, you can still end the contract, however, BG VOLEYBALL ACADEMY may not issue any refund. Please refer to BG VOLEYBALL ACADEMY’s Non-Refund Policy (Clause 3) for more details.
4.3. How to end the contract with us. If you wish to end the contract with us, you will need to contact us.
4.4. How and when your refund will be made. We will make any refunds due to you as soon as possible, using the same method you used for payment.
5. Our rights to end the contract
5.1. We may end the contract if you breach it. We may end the contract at any time by writing to you if your child, parents or guardians of any child does not follow BG VOLEYBALL ACADEMY’s Code of Conduct in its entirety.
5.2. Please refer to BG VOLEYBALL ACADEMY’s Code of Conduct (Clause 9) for more details.
5.3. Removal from BG VOLEYBALL ACADEMY’s sessions due to breach of Code, will not qualify for a refund. Please refer to BG VOLEYBALL ACADEMY’s Non-Refund Policy (Clause 3) for more details.
5.4. We may permanently stop the Sessions. We may write to you to let you know that We are going to stop providing the Sessions. We will let you know as soon as possible and will refund any sums you have paid in advance for Sessions which will not be provided.
6. Price and payment
When you must pay and how you must pay. We accept payments by Bank Transfer or Direct Debit. Payments for all Sessions must be made in advance. If you were to join the Sessions after the start of the term, the fee payable for the Term Sessions will be pro-rata the remaining Sessions of the term.
7. Our responsibility for loss or damage suffered by you
7.1. We are responsible to you for foreseeable loss and damage caused by us. If We fail to comply with these terms, We are responsible for loss or damage suffered that is a foreseeable result of our breaching this contract or our failing to use reasonable care and skill, but We are not responsible for any loss or damage that is not foreseeable. Loss or damage is foreseeable if either it is obvious that it will happen or if, at the time the contract was made, both We and you knew it might happen; for example, if you discussed it with us during the booking process.
7.2. We do not exclude or limit in any way our liability to you where it would be unlawful to do so. This includes liability for death or personal injury caused by our negligence or the negligence of our coaches or staff; for fraud or fraudulent misrepresentation; or for breach of your legal rights in relation to our services.
7.3. Please note that We hold public liability insurance for £1,000,000.
8. How We may use your personal information
We will use the personal information you provide to us only to provide the Sessions and to process payment for the Sessions. We will not pass your personal information to third parties unless you have consented to it or if required by law.
9. Code of Conduct
9.1. This Code of Conduct applies to all members of BG VOLEYBALL ACADEMY, including athletes (child), parents or guardians of any child, coaches, and staff. It sets the standards for behaviour and interactions within the Academy.
9.2. Respect and dignity. All members must treat each other with respect, regardless of age, gender, race, ethnicity, religion, or skill level. Discrimination or harassment will not be tolerated under any circumstances.
9.3. Sportsmanship. Unsportsmanlike conduct, including arguing with other athletes, engaging in verbal or physical altercations, or showing disrespect towards coaches or staff, will result in disciplinary action. We promote a culture of fairness, humility, and teamwork.
9.4. Health and Safety. Athletes and coaches must always prioritise safety. This includes using appropriate protective gear, following safety instructions, and reporting injuries immediately. We follow a strict concussion protocol for head injuries.
9.5. Social Media Conduct. Members of BG VOLEYBALL ACADEMY are expected to promote the Academy positively on social media. Inappropriate posts, including those involving offensive language or images that may harm the reputation of BG VOLEYBALL ACADEMY, are strictly prohibited.
9.6. Conflict Resolution. If any conflicts arise between athletes, coaches, or other members, they should be addressed promptly and respectfully.
9.7. Disciplinary Actions. Violations of the Code of Conduct may result in warnings, suspension, or expulsion from the Academy. Severe violations, such as harassment, bullying, or violence, will result in immediate expulsion.
10. Other important terms
10.1. Nobody else has any rights under this contract. This contract is between you and us. No other person shall have any rights to enforce any of its terms.
10.2. Separate paragraphs. Each of the paragraphs of these terms operates separately. If any of them are found to be unlawful, the remaining paragraphs will remain in full force and effect.
10.3. Which laws apply to this contract. These terms are governed by English law and the jurisdiction of the English courts.
